Waiver of liability
This is a legally binding release made by participant, who hereby declares to be 18 year old or older. The term "Undersigned" is used in this agreement as pertaining to more than one person.
I. PROGRAM
Participant desires to take part in the following program. Name of Program: European Alpine Summer Academy (hereafter, EAA) July 2023
II. WAIVER
The Undersigned fully understands that there are certain dangers, hazards, and risks inherent in international travel, and have signed this document in full recognition and appreciation of the dangers of these activities, which dangers include, but are not limited to, physical injuries (minimal, serious, catastrophic) and/or property loss or damage. The Undersigned therefore agrees to assume and take on all responsibilities in any activities associated with EAA's program in Germany. In consideration of, and in return for, the service, facilities and other assistance provided to participants by EAA (and their governing boards, employees, and agents) I, along with any of my assignees, heirs, distributes, parents/guardians, and legal representatives release EAA and its German institutions from any and all liability, claims and actions that may arise from injury, harm or death to the Undersigned and from loss or damage to the Undersigned's property in connection with these activities. The Undersigned understands that this release covers liability, claims and actions caused entirely or in part by any acts or failure to act by EAA, including but not limited to negligence, mistake, or failure to supervise by the IAA or any of their employees, agents, or contractors.
III. HEALTH INSURANCE AND MENTAL HEALTH CONDITIONS
a. MEDICAL INSURANCE
It is important to realize that most U.S. insurance coverage is not recognized overseas. The student will normally pay for medical service and fill out a claim form for be returned to the home company for reimbursement. It is imperative for students to know the limits of their coverage and to carry at least one claim form to be signed by the appropriate medical persons abroad to facilitate reimbursement. Students may wish to purchase emergency evacuation and repatriation insurance before they begin their program abroad. It is the student’s responsibility to insure that he/she has health and/or hospitalization insurance, which is applicable in countries other than the United States.
b. ACCESS TO MENTAL HEALTH TREATMENT
EAA does not employ or retain mental health professionals abroad. If a student is experiencing emotional or other personal problems that may require medical or mental health treatment, the student should consult with their current mental health provider
prior to engaging in EAA’s programs to discuss the potential stress of studying abroad. The student should know that mental health treatment and prescription medicine may not be as easily accessible in Germany as it is in the United States. EAA strongly urges the students to bring any prescription medications they expect to need with them to Germany.
IV. PHOTOGRAPH RELEASE
By signing this form, I hereby grant full and irrevocable consent to release, at any time, present or future, any voice recordings, photographs and/or video footage, for commercial and art purposes in any advertising, communication, publication or publicity
related to EAA, alone or with other persons, objects or text material, and either with or without name recognition.
V. CONDUCT / BEHAVIOR RELEASE
I understand that as a student attending a EAA program, I represent my home institution and will behave as an ambassador for this institution. Therefore, all policies governing behavior as printed in my home institution's Student Code of Conduct apply to me during my participation in the EAA program. I understand that EAA must take steps to ensure that no offensive, disruptive or potentially dangerous conduct occurs. Accordingly, EAA reserves the right to dismiss a student from the program on the basis of any observed conduct or behavior that causes concern for the safety and well being of students or others. The Director and/or Administrative Director of EAA shall have the authority to make the final decision on a participant's dismissal from the program. Misconduct includes actions that violate school regulations or German law, or in the judgment of EAA officials, jeopardize the welfare of that student, other individuals or the program. It is understood that no refund of tuition, fees or rent will be given if a student is dismissed from the program. Such actions include, but are not limited to, the following:
Excessive unauthorized absence from class and/or other organized program activities

The use of threats or physical violence

Violation of German laws

Violation of the school or housing regulations

Damage to or destruction of school, residence, or student property

Alcohol or substance abuse
-
Reckless or dangerous behavior
I, the Undersigned, have carefully read this release and fully understand its contents. I am aware that this is a Release of Liability and a Contract between me and EAA, and sign it of my own free will.

At EAA we understand that current exceptional circumstances, shared by people worldwide, may affect one’s ability to travel or to carry out plans made in advance. For this reason, EAA pledges to work together with all students and their home institutions, as well as with continuing education class participants, in order to offer everyone’s maximum flexibility, and to facilitate the largest possible refund in case of cancellations. Therefore, as long as the current COVID-19 pandemic will affect any part of the world, the following new cancellation policy will apply.
In case of programs cancelled by EAA

If exceptional circumstances force EAA to cancel a program before it starts, all fees paid to EAA, except for rent, will be refunded in full. In those cases in which rent has been paid to EAA, it too will be refunded by EAA minus any non-refundable deposit withheld by the apartment owner or residence rental agency. (That will vary depending on the accommodation type and rental agency terms. You can check with our office for specific information regarding any non-refundable deposit for your accommodation.) Students/participants who will have paid their rent directly to the hotel/apartment or residence rental agency, will receive support from EAA’s stuff to obtain their refund from their hotel/apartment or residence rental agency.

If a program is interrupted before the end of its term, any remaining instruction will be provided by EAA through online classes. Students/participants will be refunded unused costs for trips, excursions, tickets, and special events. Depending on the time of cancellation, a portion of unused rent varying from one fourth to two thirds of the total will be refunded to students/participants.
In case a student/participant is unable to take part to the program because of governmental travel restrictions
In case a student/participant is unable to attend a program in which they are enrolled because of governmental travel restrictions, even if EAA is still offering the program, EAA will provide a full tuition refund. Depending on the time of cancellation, a rent refund will be provided, minus any amount withheld by the hotel/apartment or residence agency. (That will vary depending on the accommodation type and rental agency terms. You can check with our office for specific information regarding any non-refundable deposit for your accommodation.)
In case a student/participant decides to withdraw from a program when no governmental travel restrictions are in place
If a student/participant withdraws their application at a time when the EAA program is scheduled to run regularly and there is no governmental travel restriction in place between that student/participant's country of residence and Germany, regardless of whether the program is cancelled at a later date or if travel restrictions are imposed AFTER the student/participant's withdrawal, the conditions listed here will apply and will remain valid.
The following conditions apply to a student/participant who withdraws before the Enrollment deadline, whether or not he/she has already sent the required documents and fees: the application will be cancelled and no other fee except the application fee will be required (any other fees already paid will be reimbursed). The following conditions apply to a student/participant who has completed their enrollment, and notifies EAA of his/her decision to withdraw from a EAA program:

After registration deadline, but at least three months preceding the day classes begin in that course (e.g., if classes begin on July 1st, then on or before April 1st), the student/participant will have to pay 100% of the rent for the accommodation assigned to them plus one-third of tuition;

Between 3 months and 1 month before the beginning of classes (e.g., if classes begin on July 1st, then between April 2nd and June 1st), the student/participant will pay 100% of accommodation plus two- thirds of tuition;

Less than 1 month before the beginning of classes (e.g., if classes begin on July 1st, then on or after June 2nd), the student/participant will pay 100% of accommodation plus 100% of tuition and all expenses. (The optional deep dive class is also not refundable.)
